Supreme Court Relaxes New York’s Gun Regulations

By: Chenyu Zhai

On Thursday, the United States Supreme Court struck down the gun policy in New York. The court found the original law was against the Constitution in some way.

The gun-restricted law violated the Constitution in a way that it demanded a “proper cause” to hold invisible arms in public, meaning everyone is not free to hold a firearm in public space. Six conservative judges stated that citizens of America have a right to hold “commonly used” arms in public for personal defense. Three other liberal judges objected.

The decision has expanded gun rights again, making sure that carrying arms at home and in public is under the Second Amendment of the US Constitution. This marks the biggest adjustments on guns in the past ten years in New York. In 2010, the court made the last landmark gun decision, which let personal gun ownership rights at home become a national rule.

The decision could cause more similar laws to come up in other states. Nearly one quarter of Americans would be affected in that instance.

President Joe Biden said he was "deeply disappointed" by the decision, which he said, "contradicts both common sense and the Constitution, and should trouble us all".

This wave of discussion about addressing the gun issues arose from the primary school shooting in Uvalde, Texas and a grocery store shooting in Buffalo, New York, last month, which both generated huge attention.

The New York legislation came after a new law passed the Senate, which restricts access to guns.

New York City Mayor Eric Adams said he would review other ways to restrict gun access, such as tightening the application process for buying firearms and looking at bans at certain locations. "We cannot allow New York to become the wild, wild west," he said.

However, The National Rifle Association was delighted at the ruling.

The US citizens own more than 390 million guns and more than 45,000 people were killed by arms in a single year 2020, according to BBC.

Following the decision of the court, the future judges will be more difficult in actions if they want to make laws more restrictive on guns.
